Terms of Service

These Terms of Service ("Terms") govern your use of the TalentEcho iOS app and related services (the "Service"), operated by Luke Madden, an individual based in Denver, Colorado ("TalentEcho," "we," "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and using the Service for a legitimate coaching or recruiting purpose. By using the Service you represent that you meet these requirements.

2. The Service

TalentEcho helps coaches scout, evaluate, rank, and manage prospective players — including scanning team-sheet photos, dictating notes, scoring players against your rubric, and drafting follow-up messages. Features may change over time.

3. Your account

You are responsible for the activity under your account and for keeping access to your sign-in email secure. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to: misuse or interfere with the Service; attempt to access another user's data; use the Service to violate any law or the rights of others; or upload information you do not have the right to provide.

5. Recruit information and your responsibilities

The Service lets you record information about prospective players, some of whom may be minors. This information is often about people who are not TalentEcho users. You acknowledge and agree that:

• You have a legitimate recruiting purpose and an appropriate basis for recording and using this information.
• You are responsible for complying with all laws applicable to your collection and use of that information, including laws that protect minors and students.
• As between you and TalentEcho, you are responsible for the recruit information you enter, and you will promptly address deletion or correction requests you are obligated to honor.
• You will not use the Service to harass, surveil, or harm any individual.

6. Subscriptions and billing

TalentEcho offers an auto-renewing subscription ("TalentEcho Pro") purchased through the Apple App Store.

• Plans and price: $14.99 per month, or $99.99 per year (USD; prices may vary by region and are shown in the app before purchase).
• Free trial: new subscribers may receive a one-month free trial. If you begin a subscription during a free trial, any unused portion of the trial is forfeited when you purchase.
• Billing: payment is charged to your Apple ID at confirmation of purchase.
• Auto-renewal: the subscription automatically renews for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the end of the current period.
• Managing and canceling: you can manage or cancel your subscription anytime in your Apple ID Settings > Subscriptions. Deleting the app does not cancel your subscription.
• Refunds: purchases are handled by Apple, and refunds are subject to Apple's policies. We generally cannot issue refunds directly.
• Price changes: we may change subscription prices; changes apply to future billing periods and, where required, with notice and your consent.

Some coaches may receive complimentary or promotional access. Complimentary access is provided at our discretion and may be changed or ended at any time.

7. AI features

The Service uses AI to extract details, structure rosters, transcribe and tag notes, rank players, and draft messages. AI output may be inaccurate or incomplete. It is provided to assist you, not as professional, recruiting, eligibility, or legal advice. You are responsible for reviewing output and for any decisions you make.

8. Intellectual property

We own the Service and its software and content (excluding your data). We grant you a limited, non-exclusive, non-transferable license to use the app for its intended purpose. You retain ownership of the information you enter ("Your Content") and grant us a license to host and process Your Content solely to provide and improve the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TALENTECHO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

11. Indemnification

You agree to indemnify and hold harmless TalentEcho from claims arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law, including laws protecting minors and students.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive (including Sections 5, and 8–11) survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules. You agree that the exclusive venue for disputes is the state or federal courts located in Denver, Colorado, and you consent to their jurisdiction. Before filing, the parties agree to attempt to resolve disputes informally by contacting lukemadden1313@gmail.com.

14. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date and, for material changes, provide more prominent notice. Continued use after changes take effect constitutes acceptance.
